May 1, 2026: the end of precariousness in cameroonian subcontracting?
As May 1, 2026, approaches, while Cameroon prepares to celebrate Labor Day under the theme "social dialogueand decent work: factors for peace, national cohesion, and the economic development of the company", the protection of workers within production chains is taking center stage.
Law n° 2025/010 of July 15, 2025, governing the subcontracting regime in Cameroon, provides concrete guarantees to ensure that decent work is no longer a slogan but a reality for employees of subcontracting firms.
Adherence to common law as a foundation
For the legislator, there is no such thing as a "sub-worker". Article 62 reaffirms that subcontracting companies are fully subject to current labor legislation and regulations. This reminder is essential: the flexibility of subcontracting must never serve as a pretext for the erosion of social rights.
The end of precarious and hidden practices
This year's theme, focused on national cohesion, involves fighting exploitation. The law formally prohibits:
- Illicit lending of labor: to prevent workers from being deprived of their employee status in favor of opaque financial arrangements.
- Concealed work: ensuring that every hour worked is an hour declared and protected.
- Abusive poaching: the main contractor can only recruit the subcontractor's personnel in strict compliance with the labor code.
Social security: a non-negotiable prerequisite
The economic development of the company cannot happen without social protection. Article 16 makes proof of employee affiliation and registration a condition for eligibility for subcontracting. A company that does not pay its social contributions cannot legally claim a subcontracting contract.
A safety net in case of default
The major innovation of the law lies in the solidarity mechanism during a crisis:
- Payment of wages: if a subcontractor is unable to pay its employees, the main contractor steps in to settle the wages due.
- Transparency: the main contractor is required to post the principal's address at the workplace, allowing workers and employees to pursue remedies with full knowledge of the facts.
On this May 1, 2026, Law n° 2025/010 stands as a true instrument of social peace. By strictly framing the obligations of principals and main contractors, it ensures that subcontracting genuinely contributes to economic development while offering Cameroonian workers the decent work they deserve.
